Boat transfer papers, and what people actually mean by them

Most Australians selling a boat privately search for transfer papers rather than for a bill of sale, and the two are not quite the same thing. The transfer of registration is the official step, lodged with the authority in your state. The bill of sale is the private record of the transaction itself — who sold what, to whom, for how much, on what date, in what condition. You generally need both, and the second is the one people forget until there is a disagreement.

Vessel registration in Australia is administered state by state rather than nationally, so the forms and thresholds differ depending on where the boat is registered. What does not change is what the sale document has to establish, and that is the part this template handles.

Three items, not one

A boat sale is the transaction most likely to go wrong because of what gets left off the paperwork. A car is one item. A boat is usually three: the hull, the engine and the trailer. Each can be identified separately, each can be financed separately, and the trailer is generally registered separately from the vessel.

This matters in two ways. First, a sale document that names only the boat can leave the trailer transfer unaddressed, which surfaces later when the buyer tries to register it. Second, an outboard engine can carry its own security interest independent of the hull — so a PPSR check on the vessel alone is not a complete check. Search the engine serial number as well. A buyer who pays in full for a boat with a financed engine can still lose the engine.

List all three on the document with their identifying numbers: the hull identification number (HIN) and registration for the vessel, the make and serial number for the engine, and the registration for the trailer if one is included.

What to include

• Both parties’ full names and residential addresses
• Vessel registration number and hull identification number (HIN)
• Make, model, length and year of the vessel
• Engine make, model and serial number — listed separately from the hull
• Trailer details and registration, where the trailer is part of the sale
• The agreed price, and what it covers
• The date of sale and the date of handover, where they differ
• Whether the vessel is sold as-is, and any faults disclosed
• Signatures from both parties, with each keeping a copy

Condition, and why boats are different

There is no national roadworthy equivalent for vessels the way there is for cars in Victoria or Queensland. No independent party inspects a private boat sale by default, which means the sale document is usually the only record of how the vessel was represented on the day.

That puts weight on describing it honestly. Hours on the engine, known issues, whether the boat has been used in salt water, when it was last serviced or antifouled — these are the things buyers ask about verbally and then cannot prove were said. Writing them down protects the seller more than the buyer, because a disclosed fault is not a hidden one, and a buyer who signed a document naming it has a weak claim later.

Before money changes hands

For the buyer, the order that avoids trouble is: PPSR check on both the vessel and the engine, inspect the boat out of the water if you can, confirm the HIN on the hull matches the registration paperwork, verify the seller’s name matches the registration, then pay. A seller whose name does not appear on the registration is the clearest warning sign in any private sale.

For the seller, keep a signed copy with the date of sale, and lodge the registration transfer with your state authority rather than assuming the buyer will. Until the transfer is processed the vessel remains associated with you.
