Free Massachusetts Gift Bill of Sale
Gifting a vehicle in Massachusetts to an immediate family member — spouse, parent, child, sibling, grandparent, or grandchild — saves the recipient the full 6.25% sales/use tax that would otherwise apply to the fair market value. You must complete Form MV1 (Application for Registration and Title) and mark the transaction as "Gift" when visiting an RMV branch. The 10-day title transfer window is strictly enforced, so act quickly after the transfer.

Massachusetts Gift Sale — Step-by-Step Checklist
- Obtain a signed Massachusetts title from the seller — lien release required if a loan was outstanding
- Complete the bill of sale with $0 as the purchase price and note the relationship (e.g., "parent to child")
- Fill out Form MV1 (Application for Registration and Title) and mark the transaction type as "Gift"
- Bring both parties' government-issued IDs and proof of Massachusetts residency
- Visit an RMV Service Center in person within 10 days of the gift date to transfer the title
- Obtain Massachusetts auto insurance before driving the vehicle
- Schedule the emissions and safety inspection within 60 days of registration if the vehicle is a gas-powered car under 15 years old
Common Pitfalls
- Missing the 10-day title transfer deadline triggers late fees and can complicate the exemption claim
- Failing to note the family relationship on Form MV1 can cause the RMV to assess the 6.25% use tax
- Gifting to a cousin, aunt, uncle, or in-law does not qualify — only the six defined immediate-family relationships are exempt
- An out-of-state title must first be converted; the donor should not sign the back until the RMV advises
- Skipping the emissions inspection for an eligible vehicle results in registration suspension at renewal
Massachusetts Gift Bill of Sale — FAQs
Do I need a bill of sale if the price is $0?
Yes. A written bill of sale documenting the gift, the parties involved, the VIN, and the family relationship protects both parties and supports the tax exemption claim at the RMV.
Can I gift a vehicle to my adult child who lives out of state?
The MA RMV exemption applies when the recipient registers the vehicle in Massachusetts. If they register it in another state, that state's gift or use-tax rules apply instead.
What if the title is in both spouses' names?
Both owners must sign the title over. If the title shows "or" between names, either owner may sign alone; "and" requires both signatures.
Is the annual vehicle excise tax still owed?
Yes. The gift exemption only waives the one-time sales/use tax. The recipient owes the annual Massachusetts excise tax billed by their city or town each year.
